Article 1 — Purpose and Scope

These Terms of Sale ("Terms") govern all sales of products and services offered by OddballTrip LLC ("the Seller") on the website www.oddballtrip.com ("the Site").

OddballTrip is a platform specialised in selling outdoor escape games across more than 2,000 cities worldwide. The games are GPS-guided digital experiences played on a smartphone, combining puzzles, history and urban discovery.

Any order placed on the Site implies the customer's ("the Customer" or "the Buyer") unreserved acceptance of these Terms. These Terms prevail over any other document.

Article 3 — Products and Services Offered

3.1 Outdoor escape games

OddballTrip offers digital escape games playable outdoors in more than 2,000 cities worldwide. Each game includes:

• A route through monuments and historical landmarks
• Puzzles based on the real history of the city
• Built-in GPS guidance
• An estimated duration of 60 to 120 minutes
• A unique activation code sent by email

3.2 Pricing tiers

Multiple pricing tiers are offered for each escape game, from 1 to 10 phones, with a degressive rate above the first phone. The exact applicable price is displayed dynamically on each game page.

The number of phones is the number of devices that can access the game simultaneously. Several players can share the same phone. There is no limit on the number of participants per device.

3.3 City Passes

OddballTrip also offers city passes giving access to several escape games in the same city at a discounted rate. The specific terms of each pass are detailed on the corresponding product page.

Article 4 — Order Process

4.1 Order steps

1. The Customer selects an escape game and a pricing tier
2. The Customer enters their full name and email address
3. The Customer proceeds with secure payment via Stripe
4. A confirmation email is sent immediately after payment
5. The activation code and start link are sent by email as soon as the game is ready (typical delay: 5 to 10 minutes, up to 15 minutes for a first-time generation)

4.2 Order validation

The order is considered validated as soon as payment is confirmed by Stripe. The Customer receives a confirmation email at the address provided during the order. It is the Customer's responsibility to verify the accuracy of their email address.

4.3 Availability

The escape games are digital products available 24/7. They can be started at any time after receiving the activation code, with no time slot to reserve. The activation code is valid for 1 year from the date of purchase.

Article 5 — Price and Payment

5.1 Price

Prices are displayed in the Customer's local currency (EUR, USD, GBP, etc., detected automatically), all taxes included. OddballTrip reserves the right to change its prices at any time. The applicable price is the one displayed at the time the order is validated.

5.2 Payment methods

Payment is made online via the secure Stripe platform. Accepted payment methods are:

• Credit card (Visa, Mastercard, American Express)
• Apple Pay
• Google Pay
• Stripe Link

The Customer's card details are never stored by OddballTrip. They are processed exclusively by Stripe, a PCI DSS Level 1 certified platform.

5.3 Transaction security

All transactions are encrypted via SSL/TLS. 3D Secure authentication is enabled to strengthen the security of card payments.

Article 6 — Delivery

As these are 100% digital products, delivery is made exclusively by email. The Customer receives:

• A confirmation email immediately after payment
• An email containing the activation code and game start link, typically within 5 to 10 minutes

If the email is not received within 30 minutes, the Customer is asked to:

1. Check their spam folder
2. Contact customer service at info@oddballtrip.com

Article 7 — Refund Policy

7.1 Refund before use

If the Customer has not yet used their activation code (i.e. has not started the game), they may request a full refund within 14 days of purchase.

7.2 After use

Once the game has been started (activation code used), no refund will be granted as the digital product has been consumed.

7.3 Refund procedure

To request a refund, the Customer must send their request by email to info@oddballtrip.com specifying their name, the email address used at purchase and the reference of the relevant game.

The refund will be processed within 14 days of receiving the request, via the same payment method used at the time of order.

Article 8 — Use of the Service

8.1 Conditions for using the escape games

• The activation code is single-use and strictly personal
• The game requires a smartphone with internet connection and GPS enabled
• The Customer is responsible for their own safety during the outdoor route
• The Customer must comply with traffic laws, safety rules and the regulations of the public places they cross
• The game is not recommended in extreme weather conditions

8.2 System requirements

• Smartphone running iOS 14+ or Android 10+
• Recent web browser (Safari, Chrome, Firefox)
• Mobile internet connection (4G/5G recommended)
• GPS / location enabled
• Sufficient battery (50% charge minimum recommended)

Article 9 — Liability

9.1 OddballTrip's commitments

OddballTrip undertakes to:

• Provide a quality service with historically documented content
• Ensure the availability of the platform and games
• Process orders and deliver activation codes within the announced timeframes
• Protect Customers' personal data

9.2 Limitation of liability

OddballTrip shall not be held liable for:

• Damage resulting from misuse of the service by the Customer
• Accidents occurring during the outdoor route
• Service interruptions due to external factors (internet outage, maintenance, etc.)
• Temporary unavailability of a place or monument included in the route
• Weather conditions making the route difficult or impossible

9.3 Force majeure

OddballTrip cannot be held liable for non-performance of its obligations in cases of force majeure, including: natural disasters, pandemics, government restrictions, telecommunications network failures.

Article 10 — Intellectual Property

All content on the Site and in the escape games (texts, puzzles, scenarios, photographs, illustrations, logos, graphic elements) is the exclusive property of OddballTrip LLC and is protected by applicable intellectual property laws.

Any reproduction, representation, modification, distribution or exploitation, in whole or in part, of these contents, without OddballTrip's prior written authorisation, is strictly prohibited.

Article 11 — Personal Data

Personal data collected at the time of order (name, email) is processed in accordance with our Privacy Policy.

The collected data is used exclusively for:

• Processing and delivering the order
• Sending the activation code by email
• Customer service and complaint handling

The Customer has a right of access, rectification and erasure of their data, exercisable by email to info@oddballtrip.com.

Article 12 — Customer Service and Complaints

For any question, complaint or assistance request, the Customer can contact customer service by email at:

OddballTrip undertakes to respond to any request within a maximum of 48 business hours.

Article 13 — Dispute Resolution

In the event of a dispute, the Customer is invited to first contact OddballTrip customer service at info@oddballtrip.com to seek an amicable resolution.

For consumers residing in the European Union, the European online dispute resolution platform is available at: https://ec.europa.eu/consumers/odr.

Article 14 — Applicable Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming.

For consumers residing in the European Union, the mandatory provisions of the legislation of their country of residence apply in addition, in accordance with Regulation (EC) No 593/2008 (Rome I).

Article 15 — Changes to the Terms

OddballTrip LLC reserves the right to modify these Terms at any time. The applicable Terms are those in force at the time the order is placed. The Customer is invited to review this page regularly.
